Judge Malihi Decides Against Plaintiffs of Obama’s Georgia Eligibility

DECISION
Plaintiffs allege that Defendant President Barack Obama does not meet Georgia’s eligibility requirements for candidacy in Georgia’s 2012 presidential primary election. Georgia law mandates that candidates meet constitutional and statutory requirements for the office that they seek. O.C.G.A. § 21-2-5(a). Mr. Obama is a candidate for federal office who has been certified by the state executive committee of a political party, and therefore must, under Georgia Code Section 21-2-5, meet the constitutional and statutory qualifications for holding the Office of the President of the United States. Id. The United States Constitution requires that a President be a “natural born [c]itizen.” U.S. Const. art. II, § 1, cl. 5.






As required by Georgia Law, Secretary of State Brian Kemp referred Plaintiffs’ challenges to this Court for a hearing. O.C.G.A. § 21-2-5(b). A hearing was held on January 26, 2012. The record closed on February 1, 2012. Plaintiffs Farrar, Lax, Judy, Malaren, and Roth and their counsel Orly Taitz, Plaintiffs Carl Swensson and Kevin Richard Powell and their counsel J. Mark Hatfield, and Plaintiff David P. Welden and his counsel Van R. Trion, all appeared and answered the call of the case. However, neither Defendant nor his counsel, Michael Jablonski, appeared or answered. Ordinarily, the Court would enter a default order against a party that fails to participate in any stage of a proceeding. Ga. Comp. R. & Regs. 616-1-2-.30(1) and (5). Nonetheless, despite the Defendant’s failure to appear, Plaintiffs asked this Court to decide the case on the merits of their arguments and evidence. The Court granted Plaintiffs’ request.

By deciding this matter on the merits, the Court in no way condones the conductor legal scholarship of Defendant’s attorney, Mr. Jablonski. This Decision is entirely based on the law, as well as the evidence and legal arguments presented at the hearing.






Evidentiary Arguments of Plaintiffs Farrar, et al.

Plaintiffs Farrar, Lax, Judy, Malaren, and Roth contend that President Barack Obama is not a natural born citizen. To support this contention, Plaintiffs assert that Mr. Obama maintains a fraudulently obtained social security number, a Hawaiian birth certificate that is a computer-generated forgery, and that he does not otherwise possess valid U.S. identification papers. Further, Plaintiffs submit that Mr. Obama has previously held Indonesian citizenship, and he did not use his legal name on his notice of candidacy, which is either Barry Soetoro or Barack Obama Soebarkah. (Pl.s’ Am. Compl. 3.)

At the hearing, Plaintiffs presented the testimony of eight witnesses 2 and seven exhibits in support of their position. (Exs. P-1 through P-7.) When considering the testimony and exhibits, this Court applies the same rules of evidence that apply to civil nonjury cases in superior court. Ga. Comp. R. & Regs. 616-1-2-.18(1)—(9). The weight to be given to any evidence shall be determined by the Court based upon its reliability and probative value. Ga. Comp. R. & Regs. 616-1-2-.18(10).

The Court finds the testimony of the witnesses, as well as the exhibits tendered, to be of little, if any, probative value, and thus wholly insufficient to support Plaintiffs’ allegations. 3 Ms. Taitz attempted to solicit expert testimony from several of the witnesses without qualifying or tendering the witnesses as experts. Malihi wrote hi advisory opinion and included something, that constitutes a complete fallacy and an embarrassment to the judiciary. He wrote "for the purpose of this analysis, the following facts are considered:
1)Mr. Obama was born in the United States."
This was done in flagrant, outrageous, complete violation of law and facts. The whole point of this challenge, is that Obama never presented any admissible, competent evidence, showing Obama to be born in this country. There is no original birth certificate, there isn't even a certified copy. On what basis did judge Malihi consider Obama to be born in this country? Did he consider him born in this country based on his wild imagination? The only thing Obama provided, was an empty chair. Did the empty chair testify under penalty of perjury in front of judge Malihi and told him, that Obama was born in this country? Did the empty chair provide Malihi with any evidence, with the original birth certificate or a certified copy?
This behavior of judge Malihi was so outrageous, that not only his advisory opinion needs to be set aside, as not grounded in any fact or law, but state and county grand juries and the Attorney General of Georgia need to launch a criminal investigation into actions of judge Malihi and possible direct or indirect undue influence by Obama. Decision by Malihi reads, as if it was entirely written by Obama's personal attorneys Robert Bauer and Judith Corley of Perkins Coie and rubber stamped by Malihi. It is noteworthy, that both Robert Bauer and Judith Corley need to be criminally investigated as well, as both of them were complicit in aiding and abetting Obama in presenting to the public on April 27, 2011 a computer generated forgery and claiming it to be a true and correct copy of Obama's birth certificate. Such assumption by Malihi, that Obama was born in the U.S., without any documentary evidence to that extent from Obama, goes beyond an abuse of judicial disretion, it represents judicial misconduct.

Who is Judge Malihi?

Immediately after hearing that Georgia Judge Michael Malihi ruled against the Plaintiffs in the case regarding Obama’s eligibility to be on the 2012 presidential ballot, and hearing that Malihi was a Muslim Iranian, I decided to find out all I could about him. Is his ancestry really Iranian? Is his faith really Muslim? And did either of these things, if true, play a role in his decision to side with Obama in the Georgia eligibility hearing?

I set out to find all the details I could. What I found was precious little.

Judge Malihi is the Deputy Chief Judge for the Georgia Office of State Administrative Hearings. He was appointed Judge in 1995. If you go to the official website for his office, what you don’t find may be more interesting than what you do find. On the OSAH website there is a page which lists bios for all the judges, including Malihi. I clicked on Malihi and all that was listed for him was this:

That’s it! If you click on the links for all the other judges listed, you will find a brief bio telling of where the particular judge was born, where they went to school, etc. But for Malihi? Nada! Zip! Niente! Bupkis! Nothing!

I decided to look at other websites for other state or federal judges to see if its common practice to have absolutely no information listed in their bios.

The Federal Judiciary Center has a massive list.

The directory includes the biographies of presidentially-appointed judges who have served since 1789 on the U.S. District Courts, the U.S. Courts of Appeals, the Supreme Court of the United States, the former U.S. Circuit Courts, and the federal judiciary’s courts of special jurisdiction.

I examined a sampling of about 50 judges listed on this site and they all had bios which contained at least when and where they were born, when they died if applicable, where they went to school, where they practiced – their career path.

At the official Supreme Court site, bios of all judges were listed.

I looked up judges in various states, in a variety of different roles and guess what? Out of the approximately 15 different sites I visited for different states, bios were present for all judges! I looked up Circuit Court judges, Appellate judges, Superior Court judges, and more. They ALL had bios listed.

Nothing on Judge Michael Malihi.

Isn’t that interesting? So I ran searches on several search engines on his name. Was I able to find out much more?

On Google, all I found was essentially what has already been posted on this blog, and others regarding his recent ruling in favor of Obama and his eligibility to be on the 2012 Presidential ballot in GA.

I got pretty much the same, which is next to nothing, on Yahoo, Bing, Dogpile, Ask, Alltheweb, Mamma, Excite, Alta Vista, and a variety of others. Honestly, I got tired of looking because they all contained the same data. For a judge that has been in his position since 1995, doesn’t it seem odd that he has next to no information out there about him?

I wasn’t willing to pay to get more detailed info on him, but it’s not out of the question for a later time.

I noticed that Intelius offered an alternate spelling of his name. I decided to look into the name Molihi. Pretty much everything led back to the name Malihi. I will look more into that later as time permits. I also noticed that listed as locations where he lived is Connecticut. Wasn’t that where the social security number was issued that Obama is using, or has used? Wonder if that’s got any legs?

I decided to see if there were any archived versions of his official bio page using Wayback Machine. Its only shows that it has been crawled once by Wayback back in May of 2010. It shows the same information that his bio page shows today. He has been in his position since 1995, yet he is the only one without a full bio? I used a few other similar cache search engines and found the same thing. Nothing. I tried Google cache, Yahoo cache. Still nothing different from the bio page you see linked above. My goal was to see if perhaps there was a bio up at one time, but recently changed. It appears, as far as I can see, this is not the case. He never offered a full bio.

This leaves me scratching my head. I wasn’t able to answer any of my questions. Why? Why can we find even less info on him than we can on Obama? Birds of a feather? Who knows. Anyone who can lead me to more information about this man please offer it in the comments below. Until then, Judge Michael Malihi remains a mystery.

Maybe he doesn't want crazy, racist arseholes making assumptions about him based on where his father was born, or what invisible man he believes in?

How difficult (or expensive) could it possibly be to get experts in forged documents? It's one of the most common types of fraud.

If Orly Taitz had the slightest bit of sense, she'd find dispassionate professionals who hold no strong political opinions, and get them to testify only in their areas of expertise...you know, like a lawyer who is competent might do.

I believe in Nazi moon bases, inter-dimensional incursions, and all manner of cryptids, but you guys are fucking crazy if you think these rank amateur, ideologically driven fantasists could blow a hole in a deep cover intelligence operation capable of placing a man in the Oval Office.

If the wheels ever do come off for Obama, it won't be because of small bore stuff like birth certificates.

the big question here is why on earth would an Iranian Muslim judge, who had Obama cornered with no identification papers let him go free???

As you know, Barack Obama was cornered in the state of Georgia on January 26, 2012. I issued a subpoena for Obama to appear at trial and produce valid certified copies of his long form birth certificate, redacted application for the Ct SSN 042-68-4425, which he is using, his passport and immigration records. Obama did not appear, did not produce any documents. According to GA law the candidate had to produce documents. Even if I were to produce nothing, the judge had to rule in my favor, as Obama did not produce anything to prove his eligibility. I went further and produced 208 pages of evidence and at my own expense of over $11,000 flew 7 witnesses from all over the nation. I flew in another attorney and computer/projector tech support person, we conducted a mock trial a day before the hearing (some witnesses arrived late due to airport delays and did not participate in mock trial). I brought a senior deportation officer, who testified, that with anybody else, he would be seeking a warrant for an arrest and deportation considering fraud in use of identification papers, such as observed with Obama. See the documents and transcripts attached, showing Obama using a stolen CT Social Security number, which was issued to a resident of CT born in 1890, as well as using a computer generated forgery instead of a valid birth certificate. Obama not only was supposed to be removed from the ballot, he was supposed to be sent to prison at the very minimum. When I am saying prison, I am being very generous.

Suddenly this corrupt judge decided that Obama can be on the ballot. I researched the background of this judge and found out that he is an Iranian Muslim, who live in Boston and went to Boston University law school the same time as Obama went to Harvard. There is a good possibility that judge Michael Malihi and Barack Obama knew each other for some time. While there ae bios of every judge in the administrative court of GA, there is no bio for Malihi. There is no evidence of him working for any firms. There is a serious concern, serious question, whether former governor of GA, Democrat Zell Miller got some type of consideration to put Malihi in the position of an administrative judge without Malihi having sufficient experience. More importantly, there is a bigger question, what consideration did Obama give to Malihi, in order to keep Obama on the ballot without any valid identification papers, and not forward all of this information to the DA and AG for criminal prosecution of Obama.

Yesterday, only a few days after the trial, as I just filed an appeal of Malihi’s decision, Obama announced, that he plans destruction of 80% of the US nuclear weapons arsenal. This unilateral insane disarmament will make U.S. less armed, than China. The question is, who is judge Michael Malihi, does he still have ties with the radical Muslim government of Iran? Did Obama make a deal to destroy 80% of the U.S. nuclear weapons in exchange for Malihi keeping him on the ballot as a Presidential candidate and not sending him to prison for use of forged Social Security card, forged long form birth certificate, elections fraud, wire fraud, Social Secuity fraud and other related crimes?

Please, call each and every member of Congress, each govertnor, Attorney General, go with this evidence to grand juries, to each and every radio and TV station and news paper. This nationb is being destroyed from within. We have to act now, before it is too late.
