Or even manslaughter. Or even assault. Couldnt find much about this elsewhere on here and thought it deserved its own thread.
Ian Tomlinson was walking home from work during the G20 Summit last year when he was the victim of an unprovoked attack from the riot police - an officer (PC Simon Harwood) pushed him in the back as he walked, and he fell to the floor. About 20 minutes later he dropped dead of a heart attack.
Initially, the Coroner investigating the incident appointed a Pathologist to the case who was under investigation by the General Medical Council for being, well, grossly incompetent at his job. The Coroner was fully aware of this fact. Unsuprisingly, the Pathologist's report (conducted with NO other medical expert present) was that Mr Tomlinson died of a naturally occuring heart attack. The Pathologist (Mr Patel) noted that he found "intraabdominal fluid with blood about 3l with small blood clot" inside Mr Tomlinson's chest. He also failed to retain that fluid so it couldnt be further examined.
However, when further examinations were conducted by Pathologists that were actually remotely competent, it was found that the cause of death was related to internal bleeding from injuries sustained from the fall. Two different Pathologists confirmed this.
However, when the case came to court, the ruling was made that, due to the initial report from Mr Patel and the doubt placed by his incompetence and the investigation into his previous work, there was no way to prove beyond reasonable doubt that the officer was the responsible. As he was the first Pathologist to conduct a post-mortem, he would have had to testify for the prosecution as a wtiness to the 'primary facts', and due to the fact that a) he got it horribly wrong and b) he got it horribly wrong ALONE (i.e. with nobody else in the room to verify anything he did), that creates reasonable doubt, with the QC citing 'irreconcilable differences' between medical reports
So to sum up, the Coroner knowingly appoints a Pathologist who will undermine the integrity of the case from day one. Confusion ensues. Police officer walks free.
I dont know, to me it seems pretty simple - man caught on video pushing victim to the floor, victim dies, two post mortems conclude that fall is likely cause of death. How are we not seeing a conviction here?!?
However, the other way around and you can bet your bottom dollar that Mr Tomlinson would have the book thrown at him, dodgy pathologists or not. Why they couldnt take the other two reports as evidence is beyond me, but to be fair i'm not very well versed in the workings of the justice system. Still stinks of corruption and conspiracy though. At the very least Simon Harwood should have been charged with common assault, but no criminal charges will be brought.
So the message from the police is loud and clear:
'Shut up and do what we tell you, when we tell you - we are above the law'
Harwood has twice been investigated in the past for aggressive behaviour also.

I've stuck up for the police before when people are blindly shouting 'POLICE BRUTALITY MANZZZ' purely through going out and specifically looking for it, or goading them into it. But this shit stinks, and the worst part is its in the national psyche through the media, but nobody appears to give two craps apart from the guardian half heartedly and indirectly calling for the Coroner to resign.
