Winning the lottery isn‘t quite what it’s cracked up to be. At least not for one illegal immigrant, Jose Antonio Cua-Toc, who won a $750,000 jackpot in Georgia but was reluctant to cash in his winnings for fear of alerting authorities to his immigration status. To avert danger, Cua-Toc asked his boss to claim the cash prize for him, but Erick Cervantes and his wife allegedly stole the money and started spending it all.

That’s when Cua-Toc lost it.

According to Fox News, Cua-Toc was then arrested after allegedly threatening to kill Cervantes and his wife.

Well, the authorities certainly know about Cua-Toc’s immigration status now.

Now, he apparently has a week and a half to leave the country on his own accord or face deportation. But Cua-Toc is standing his ground, fighting the deportation and suing Cervantes to return his lottery winnings.

During Kelly’s Court, Lis Wiehl argued that since Cua-Toc couldn’t present a valid social security number, which is required to claim lottery winnings, he was exempt from collecting the prize in the first place.

Mark Eiglarsh, however, argued that Cua-Toc’s immigration status does not affects his legal right to recover money that he won lawfully.

DiggRedditTumblrPermalink. On Feb. 3, a man walked into N&K Quick Pick in the Rockland County village of Spring Valley and purchased a $10 scratch-off instant lottery ticket. It was a $3 million winner, but it turned out to be anything but instant.

When the man, who speaks limited English, told a store clerk that he had stumbled upon a fortune, the clerk, according to the authorities, hatched a plan with the store’s owner and a third man. They told the man, an illegal immigrant working as a painterthat he would be deported if he tried to claim the winnings.

“When he presented the ticket, they scared the hell out of him,” said Thomas P. Zugibe, the Rockland County district attorney.

The three persuaded him that they would arrange for him to get some of the money if he gave the ticket to the clerk, Atif Ali according to Mr. Zugibe, who said Mr. Ali collected the first $150,000 annual payout and sold the rights to the rest for $600,000.

After waiting several months without receiving a dime, the ticket buyer hired a lawyer, Thomas Sassone.

“They basically defrauded him,” Mr. Sassone said. He asked the New York Lottery to investigate, the district attorney was called, and over the last two weeks, Mr. Ali, of Spring Valley, N.Y.; the store owner, Riaz Khan of Monroe, N.Y.; and Mubeen Ashraf, also of Monroe, were charged with first-degree grand larceny.

The three men could not be reached for comment on Friday, and Mr. Khan sold the store in July. The arrests were reported Friday by The Journal News of White Plains.

To collect a jackpot, a winner must sign the back of the ticket to prevent others from claiming the prize, said Carolyn Hapeman, a spokeswoman for the New York Lottery. But the rightful winner of the $3 million ticket, whose name was not released, had already signed it. So Mr. Ali, according to Mr. Sassone, had the man sign a document attesting that they bought the ticket together.

Though Ms. Hapeman said lottery officials were skeptical, they authorized the first of 20 annual $150,000 payments. She noted that lottery officials do not ask for the immigration status of winners.

Mr. Ali, the authorities said, then sold the rights for the rest of the jackpot to a company called Advance Funding for $600,000.

An office manager at Advance Funding, who declined to give her name because she was not authorized to speak for the company, said it made the payment after the New York Lottery sent documents that said Mr. Ali had purchased the ticket.

Most of the money was deposited in a bank account that the authorities have now frozen. The real buyer will most likely receive that money, but it is still unclear, Mr. Zugibe said, how much of the rest of the $3 million jackpot he will get, since Advance Funding may claim it still has the rights to it.

“We’re not looking to hurt anybody,” said Mr. Sassone, the winner’s lawyer. “He just wants to get his money back and to get left alone.”

In a footnote to this story this author (me) remembers a case several years1970-80's back when an American citizen won the Irish Sweepstakes and could not collect because he was not a citizen of that country.

Nope, should be denied, and deported.

And the "Boss" and his wife should be jailed for not only taking advantage of the situation, but for the use of illegal immigrants.
They should have the heaviest fines and jail time passed on to them for their actions, and be made an example. Take their home, cars, money and items of luxury.
They do the same and worse for peeps who sell weed. This is much worse of a crime, so they should suffer for it.

The people of the US put the money in, after ( in most cases) working and paying taxes, that generated that pool of monies.

Sucks but, Jose should have gone through the process to become a citizen.

Some race based group will get involved and they will likely get to keep it before they leave the country with their winnings.

No he shouldn't be deported, nor should any illegal "immigrant" The USA is engaged in a WAR we are told. What do normal countries do with "illegal immigrants" in a time of war?

They are at least as big of criminals as these illegals. They have encouraged these potentially dangerous illegals to cross our Boarders as easily as easy as pie, suck up our dwindling dollars, when in fact they should get the "Gitmo Bay Treatment" and executed if found guilty.
Partially to blame for this are the Hispanic/Latino population of the USA: Every time "illegal entry" is mentioned, they mistake legitimate laws for "racism" by assuming we mean them exclusively.

I sincerely appreicate you feedback but most recently and this is documented and just on FOX news also Google any american who is considered byt the PRESIDENT who is going against the 5th amendment to the Consitutiton can now be shot overseas or here with out due process...

so, its not just Bush its the "annointed one" who is acting like a KING who is promoting this as well as "drone's". Now being ok to be flown over your town anywhere.

Hang on cause the sheeeeeet is gonna hit the fan...not from me but from those who probably don't like it very much.

Agree on points 1 and 2, point 3 is a bit unrealistic tho, that is likely a check to all the poor peeps for 1 or 2 cents, maybe less.

and what bar determines the evaluation of "poor"

that is really another topic tho.

Buy a million $ green card :alien51: If i were in another country and bought and won a lotto, i'd want MY winnings. Its easy for a part of me to say, deport him and keep the cash in OUR system. But really, didnt he win fair and square? Still, send him back to his own country. Maybe he will start a manufactoring business and put some of his own countrymen to work. But my brain also thinks since he was here as an illegal, it voids that ticket. Btw, i would not be in another country without my legal papers. So yea, fuck him!!!

I don't see what winning the lottery has to do with immigration.
He paid his money he is entitled to collect his prize, there are no ifs or buts, imagine anyone on here going into Vegas dropping the jackpot and the casino says well you cant have it because you don't live in Vegas, you would be far from happy, I know it is an different analogy as such, but the principle remains the same.
Whether immigration want to pick him up after collecting his winnings is entirely their choice/duty but don't deny the man his rights to winning the lottery.
Lottery is massively boosted by illegals money like it or not, if you are going to stop it, you stop it at source, show legality before purchase, then there wouldn't be any need for this discussion.
