An Alberta farmer who shot a man stealing his ATV three years ago will not spend time behind bars.

But the province’s top court ruled in a split decision Friday that Brian Russell Knight will get a criminal record for going too far in defending his personal property.

A trial judge had sentenced Knight to 90 days in jail, but the Alberta Court of Appeal substituted a suspended sentence, three months probation and 50 hours of community service for the Bashaw-area resident.

Knight’s lawyer, Balfour Der, said his client is relieved his legal ordeal is finally over.

I remember this when it happened.
Sending him to prison for defending his land was in my opinion wrong.
If I remember correctly the reason he went to prison is because he shot that 16 year old boy in the back while he was trying to run away. I am sure had he of known it was just a boy he might of not shot him, but who knows.
Still it was a bad decision sending him to prison. He had been targeted by the same crew and they pushed him over the edge.
I think it was a firm of gypsies who were targeting the area and so they are as much to blame as he is for the killing of this boy, as over here younger members of these firms are used because the courts are much more lenient with minors and more often then not they escape prison.

The act was created in response to the Snowdrop Petition following the Dunblane Massacre. The previous Conservative government had followed the recommendations of the Cullen Report on the massacre and introduced the Firearms (Amendment) Act 1997 that banned "high calibre" handguns, greater than .22 calibre (5.6 mm). This new (No. 2) act further banned the private ownership of all cartridge ammunition handguns, regardless of calibre.

You can own a handgun, but you can not take it out of the gun club. :roll:
