Goodman Law Group Seeks Costco Video of West Point Grad Allegedly Slain by Vegas Police

LAS VEGAS--(EON: Enhanced Online News)--Goodman Law Group reports that Erik Scott was shot by police outside a busy Summerlin, Nevada Costco store July 10. Many questions surround the shooting of Scott, who was carrying a licensed concealed weapon in a holster when he was surprised by officers as he exited the building with his girlfriend and other customers. Five of the seven shots that felled him were fired into his back.

.Ross Goodman, attorney for the family of Erik Scott is questioning the official sequence of events. Erik was a graduate of the US Military Academy at West Point and had an MBA from Duke University. The case claims that if an educated, responsible, militarily-trained individual with a concealed weapons permit did not understand the instructions of the police, then any average citizen is at great risk of getting killed by police in a similar situation.

Much information regarding the incident has been withheld pending a coroner's inquest that was originally scheduled for September 3. The Clark County Coroner said the inquest was indefinitely postponed at the request of the District Attorney's office, which said additional witness statements are being gathered and surveillance videos are being reviewed by an out-of-state forensic laboratory. Testimony to be presented is expected to last two days, then a jury will determine whether the officers' actions were excusable, justifiable or criminal.

The district attorney won't release the recordings of 911 calls or surveillance videos until the inquest, and has not set a new date for the hearing. Until then, the family must rely on the statements of eyewitnesses, while continuing to request the release of the video data. Dozens of citizens have inundated the Costco Facebook page, and billboards in Las Vegas demand the video be released. An unauthorized transcript raises questions about what police were told by 911 callers.

Police claim Erik Scott pointed his gun at them outside the store's entrance after 911 callers reported him acting erratically and damaging merchandise. There are reports from witnesses that dispute each of those statements. Several witnesses said Scott appeared to be surprised and possibly confused by conflicting instructions from officers.

"We know there were four cameras outside of Costco that would've captured the shooting. We know that there was a camera within Costco, on the aisle, which would've covered allegations that Mr. Scott was acting erratically," said Goodman. "All they have to do is provide video and the tapes."

Erik Scott’s father, Bill Scott, 63, of Colorado Springs, is a journalist, author and former Air Force captain. He is calling for greater police accountability and for reform of Clark County's coroner inquest process. He said officer-involved shootings should be reviewed by third parties. “It’s been three weeks. They should release the video and 911 calls.”

LAS VEGAS -- We are now getting our first listen to what police officers encountered in July's shooting outside a Summerlin Costco. Three officers shot Eric Scott seven times after they say he pulled out a concealed handgun.

Las Vegas police's radio traffic from that day reveal what officers heard minutes before they fatally shot Eric Scott outside the front entrance to Costco.

Over the radio, you can hear the officer make the shot's fired call and then ask for medical units. The officer then says, "He pulled a 413 and pointed it at my direction." That "413" the officer refers to is police code for a firearm.

Minutes before, employees at Costco called 911 about Scott. According to the radio recordings, Metro was told Scott was acting erratic and throwing merchandise on the ground.

Metro dispatchers told officers in the field that Scott was possibly on drugs, and may have been suffering from excited delirium. The radio recording shows what officers were hearing about Scott's state of mind.

"He's throwing merchandise around. He's still in aisle 126 in the camping area. Break. Appears fidgety. A female joined the male. She's described as Hispanic, 30's, black long hair, wearing black tank and blue jeans," said the dispatcher.

That woman mentioned by police was Scott's girlfriend, who was there at the Costco.

Scott's family and multiple witnesses say that Scott did not have a gun in his hand as police shot him. Scott was a medical supply salesman and West Point graduate.

The recordings were posted on radioreference.com, a website that records police channels, and later posted on YouTube.

Metro says they have not had a chance to compare these online recordings with their own recordings to see if anything was left out.

Metro also says in a statement,"The tape speaks for itself. It demonstrates the professionalism that police handled the situation."

In a statement, the Scott family attorney, Ross Goodman, said, "Metro will not release the recording of the 911 calls and Costco surveillance video until the inquest which has been indefinitely postponed. Instead, Metro wants to hide behind the veil of secrecy of an ongoing investigation and leak only audio portions of the officers transmissions without all of the officers responses contained in the MDT (Mobile Date Terminal). The family deserves a complete chronology of these events and the public is entitled to it."

The coroner's inquest into the shooting was scheduled for September 3, but has been delayed indefinitely.

Las Vegas, NV- For the first time the public is hearing one side of what led to police to shoot and kill a man at a busy Costco store in Summerlin. The newly released audio recordings give us a glimpse of what happened that day.

The audio is Metro officers dealing with dispatch through their radios. But this audio was not officially released by law enforcement, it was posted for the world to hear online.

"Shots fired! Shots fired!

The chilling words first heard over airways of scanners July 10, have made it to the Internet. The audio comes from 2strokeYardSale. Posted on youtube, they give the public the first insight into what happened that day.

"The male inside the business is acting erratic. Throwing merchandise around, possibly high on unknown 446(Narcotics)," says the dispatcher.

Metro police have not released any audio recordings or video of the day Erik Scott was shot and killed by officers at a Summerlin Costco, raising a lot of questions about what happened that day. This recording has dispatchers talking about what prompted the call from store personal.

"It looks like the subject is in store, inside the business. He's argumentative with the manager who asked him to leave. Telling him there's no 413's (guns) allowed inside the business place."

"Says the manager he's a green beret and is allowed to carry a 413 (gun)."

Officers on the way are advised to be discreet.

"Have those units shut down code when they get close. Let's not get this guy anymore excited than he already is," says one officer.

Scott is then described to be walking down the main aisle of the store with his girlfriend as staff begin evacuating the building.

"If we can get the management and employees to start slowly evacuating people out of the business without alerting everyone that would be a great idea," says an officer.

Then officers spot Scott near the front of the store.

"Shots fired! Shots fired," yells one police man.

The audio recording even has one officer explain the shooting.

"He had 413 (gun) pointed in my direction."

We tried contacting the person who posted the scanner audio, 2strokeYardSale, but did not get a response. Some people believe this audio was leaked by Metro and edited. One of those include the Scott family lawyer, Ross Goodman, who says...

"Metro wants to hide behind the veil of secrecy of an ongoing investigation and leak only audio portions of the officers transmissions without all of the officers responses....The family deserves a complete chronology of these events and the public is entitled to it."

The recordings of the 911 calls and the Costco surveillance video have not been released yet. That may come at the coroners inquest, which right now has been postponed indefinitely.
