JCT Confirms Failure to Comply with Democrats’ Mandate Can Lead to 5 Years in Jail

Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail. The JCT letter makes clear that Americans who do not maintain “acceptable health insurance coverage” and who choose not to pay the bill’s new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.

In response to the JCT letter, Camp said: “This is the ultimate example of the Democrats’ command-and-control style of governing – buy what we tell you or go to jail. It is outrageous and it should be stopped immediately.”

Key excerpts from the JCT letter appear below:

“H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.” [page 1]

“Criminal penalties

Prosecution is authorized under the Code for a variety of offenses. Depending on the level of the noncompliance, the following penalties could apply to an individual:

• Section 7203 – misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.

• Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.” [page 3]

When confronted with this same issue during its consideration of a similar individual mandate tax, the Senate Finance Committee worked on a bipartisan basis to include language in its bill that shielded Americans from civil and criminal penalties. The Pelosi bill, however, contains no similar language protecting American citizens from civil and criminal tax penalties that could include a $250,000 fine and five years in jail.

“The Senate Finance Committee had the good sense to eliminate the extreme penalty of incarceration. Speaker Pelosi’s decision to leave in the jail time provision is a threat to every family who cannot afford the $15,000 premium her plan creates. Fortunately, Republicans have an alternative that will lower health insurance costs without raising taxes or cutting Medicare,” said Camp.

According to the Congressional Budget Office the lowest cost family non-group plan under the Speaker’s bill would cost $15,000 in 2016.

program snaking its way through congress. This is Pelosi's version.

Are you an independent contractor that can afford a $15,000 policy to avoid a $250 THOUSAND dollar fine and up to five years in jail?

No, this isnt spin, this is the law as it is written, along with its implications.
Frankly i give not a shit that its her name on the Bill..names dont matter at this level.

Truly ask, can YOU afford $15,000 a year in insurance premiums?
(some of you may pay that now, totally granted)

Most of us cant.

I'll be one of the first to go to jail if this is indeed true. I can't find a copy of the bill anywhere....Can anyone direct me to a copy of the bill??

I'm a poor college student...Before the housing market crash , I was painting houses for $12 per hour, but since then the painting industry has all but collasped. No one can afford a professional paint job or remodel if they are in risk of lossing thier home to the banks. My last employer laid me off last October and I've been drawing unemployment ever since. I have gone back to school, and have been able to get some student loans and grants to help pay for it with a little left over to help pay the bills, but if it wasn't for my girlfriend working as a waitress, we'd be living on the street cause unemployment only pays me $225 a week.

I'm 33yrs old and haven't had health coverage for well over a decade now. Per that, I have become a naturalist and tend to my own health as well as my family's. Vitamens, suppliments, herbs, teas..ect..ect...ect.. They have worked very well for us and no one in my family has been sick for a very long time now.

There is no way in hell we can afford health insurance! Even when I had a job, I was only making $18.200 a year...and they want $15,000 for health insurance?? NO WAY is that fesable!! Even if my girlfriend bought coverage from her employer it wouldn't cover me cause we are not married, plus she'd have to give most of her tips back to the company to pay for it, and her tips is what we basically live on...week to week, sometimes, day to day. Needless to say...with the economy in its current state, tips are lacking!

Our only hope (as of now) is getting me through school so I can get a decent job that pays more than peanuts. But there is a flaw in that as well....when I graduate, I'll have almost sixty grand to pay back in loans.......

:shooting: You folks may be hearing about me on the t.v. if this bill passes.....if they come to arrest me for no health insurance, they have a serious fight on thier hands...I won't go quietly! :nwo:

IMPORTANT UPDATE!

First off, no I cant find a copy either.
Pelosi promised to have the bill up 72 hours before its passage, but just like the LIEs that Obama told us about transparency, she has steadfastly refused to do so, even when prompted by news organizations, who wanted to read it for themselves as well.

PART II

On the INDIVIDUAL policies,
it does appear that those run between $5-7k per person,
depending on situation...

So my full apologies for not knowing there was a break down..
The $15K appears to be for married families filing jointly..

But still, 5-7K or 15k...
Heavy burden on most.

Still lookin..

OK, and see for all those who want to sluff off my opinions as Obama bashing, i dont gove a flying handful of shit whos in the Presidency at this point, i really dont, i just want to see rational decisions being made about our future.

These hidden costs..THIS IS WHAT THE NEXT TWENTY YEARS looks like!
The bailouts, stimulus, cash for clunkers, first home programs...ALL of this stuff is GOING TO BE PAID FOR in ways like this, dropped on you silently from above, with no debate, no public postings..because they KNOW how mad people are going to be when they realize, that NO, um yeah WE ACTUALLY HAVE TO PAY OBAMAS BILLS...

I can't find anything on penalties for not having insurance..., but I did find a line or two about folks that make a certain amount per year and opt out of coverage will have to pay a tax to the "health trust fund" up 8% of thier income. And companies that make less than $500,000 a year are exempt from penalties... :?: :?: :?: .
