for big businezz - Piracy iz ok.

Translation from the Russian Kommersant

Experts in the field of maritime law agree that Russia has little chance of defeating a lawsuit with the Netherlands. According to the leading lawyer of shipbuilding and shipping company "Inmarin" of Victoria, July Zhdanova, the Netherlands authorities will try to prove that the charges against environmentalists, referring to art. 101 International Convention on the law of the sea, which gives the definition of piracy. "It is clear that the actions of environmentalists do not fall under this definition, therefore, the actions of the Russian border guards, most likely, will be declared illegal," said the lawyer. "b" is illegal, therefore, will be recognized and the detention of the ship and its crew. " The lawyer stressed that the wording of article "piracy" in the Russian Criminal Code and the International Convention on the law of the few, but the gist is the same: "piracy must necessarily involve the direct intent of attackers to seize foreign assets in their own selfish interests. This means that the classification action conservationists inappropriate nor on the Russian CRIMINAL CODE, nor the International Convention ". From Russia during the proceedings may be required to compensate moral and material damages. "In our practice of daily downtime at the port should be around 100 thousand. rubles, "explained Victoria Zhdanov. According to Kommersant, the expert on international law, 2007 Turtle Dove Sergey, the Court had already considered a similar claim against the RUSSIAN FEDERATION, filed by Japanese authorities. "It was about our border guards detained two fishing boats in the Pacific Ocean. Then the International Arbitration Court has recognized that the Court had been illegally detained. In the case of the Arctic Sunrise is very similar: this ship, too, was detained in international waters, so the chances of winning in the Court of the Netherlands is quite high, "he explained.
