Back in Europe, the machine that is in the process of developing one of the most restrictive systems for natural health anywhere is gathering pace. Brussels is the nerve centre for the European game plan, and the Lisbon Treaty has now, at least in relation to health and security matters, devolved nearly all power away from the Member States, into Brussels. Making matters worse, the rate by which amendments (‘delegated acts’) now fly through the EU rule-making system is truly frightening. Parliamentary scrutiny is minimal and in many cases the sheer barrage of these delegated acts coming through is such that it’s very difficult for our elected representatives (Members of the European Parliament) to keep up.

Our executive and scientific director, Robert Verkerk, speaking of this process following his return last week from a lobbying excursion in Brussels, said, “It’s akin to spearing fish in a fast moving stream. It’s easy for MEPs to miss key acts coming through this side door. These acts are likely to contain the detail that does particular damage to particular sectors, while seemingly innocuous framework directives and regulations come through the main door and go through the full co-decision process with the Member States and Parliament. This side door of delegated acts, given extra impetus by the Lisbon Treaty, is the thing that worries us most. We need to work very closely with the Parliament to stay on top of the process and help MEPs revoke acts that are not in their citizens interest.”

It seems clear this is how the EU will try to pass draconian measures to limit maximum dosages of vitamins and minerals. The ANH has critiqued in peer review this process and found that the methods being contemplated are deeply irrational scientifically. In meetings last week with the European Commission, Dr Verkerk was told that the Commission cannot indicate when it plans to publish its proposals, blaming the delays on the appointment of the new Commissioner for DG SANCO, Mr John Dalli. Only the Parliament can now stand in the way of the process and at ANH we want to make sure we don’t miss the fish in the stream.

The EU’s plans on health claims are under massive attack. The reason? The key European institution evaluating health claims has now published its second tranche of claims, and the vast majority are negative. This is a disaster for health education. When the EFSA has completed its evaluations, the approved list of claims will be the only claims of benefits that can be made. And not just on product labels—the Nutrition and Health Claims Regulation affects also the spoken word, at least in commercial contexts.

With so much of what is going on in Europe and further afield, it is the impact of the totality of legislation that can have such a dramatic effect on our lives. Individual laws, in themselves, may not seem too drastic, but when you add together the combined effects of them, particularly once they are all fully in force, the effects are likely to dig deep into the core of our fundamental rights and freedoms.

At ANH, we are already investigating the potential for legal challenges on human rights grounds.

We need to be prepared, as there is much to be defended.

My letter to you with regards to:
Regulation of herbal medicine practitioners

I understand the government has recently consulted on the issue of statutory regulation of traditional and herbal medicine practitoners.I am very concerned about the impact if statutory regulation does not go ahead.

Currently i am able to obtain manufactured herbal medicines from my herbal medicine practitioner,who buys them in and supplies them as part of my treatment.From April 2011 when the Europen directive on traditional herbal medicinal products comes into force such medicines will only be available to professions which are regulated by the state.

If the government fails to introduce the statutory regulation of traditional and herbal medicine practitioners i will no longer be able to benefit from these medicines.(I only started taking the herbs when all of conventional medicine had failed me,the medicines have changed my life).I maybe able to obtain these medicines illegally,for example,over the internet,but this is not a route i wish to take as their quality would not be assured and i need the guidance of a trusted health professional.

I understand that the case for statutory regulation of herbal medicine was accepted in a house of lords select committee report in 2000,and in 2006 the government stated it's clear commitment to the statutory regulation of herbal medicine,acupuncture and traditional chinese and ayurvedic medicine practitioners.

I urge the government to act now so that i,and the many other people who rely on herbal medicine can continue to receive the high quality treatment and products that we need.

And here's an update on the senator mcain supplement bill,it's far from being dead as was reported....it will die if we want it to but we must take action....people of the U.S are in the same predicament as people in the EU with regards to supplements...funny that...

If you’ve been following the saga of the so-called “Dietary Supplement Safety Act” or DSSA, S.3002, which would have sacrificed our dietary supplement freedoms for the false “safety” promise of Codex Alimentarius restrictions, died, as it should have, just a month and a day after it was submitted on February 4, 2010.

Huge Push Back from the often fractious Health Freedom Movement (led by HealthFreedomUSA.org’s 390,000 emails to decision makers over a couple weeks) showed Senators McCain and Dorgan the error of their proposal… or did it?

We’ve reported on the developments in this matter several times on this blog and on the HealthFreedomUSA.org blog. We warned that DSSA, by substituting a Codex-compliant “Accepted Ingredient List” promulgated by the bureaucracy for the current law, DSHEA (Dietary Supplement Health and Education Act of 1994) and its determination that dietary supplements are foods and as such are generally considered safe if used as directed, would, like the allowed ingredient list now in effect in the EU, take up to 80% of dietary ingredients off the market… exactly as is happening in Europe now.

WE SAID “NO!” TO NEW WORLD ORDER RESTRICTIONS ON OUR LIBERTY! YOU ALL PUSHED BACK SO HARD THAT THE GLOBALIST PLAN FAILED.

But, they haven’t given up. Earlier today the senators let “the other shoe drop” and in a letter to Senators Hartkin and Hatch, asked that the HARMonization language be inserted into the other fake “safety” bill before the Senate, S.510 which would force the industrialization of what’s left of natural, family and community food production. A very bad bill by itself; an even worse bill with DSSA added!

Here is what the senators want, with my comments in [brackets]:

* requiring all dietary supplement manufacturing, processing and holding facilities to register with the Secretary of Health and Human Services; [Food companies already have to register and dietary supplement facilities, as food facilities, already register under food security laws; this authority superfluous.]

* giving FDA mandatory recall authority if a dietary supplement is adulterated or misbranded; [Already in the law; just a year ago FDA banned a form of Vit B6 under its already existing Section 301(11) authority; another superfluous grant of power to an agency that Dr Ron Paul says "abuses power..."]

* requiring FDA commissioner to publish new dietary ingredient guidelines; [This is the heart of the attack on dietary supplements; it refers to the authority McCain and Dorgan wanted to give FDA to establish the Codex-style approved ingredient list, gutting DSHEA.]

* mandating that FDA notify DEA when a new product contains a synthetic anabolic steroid. [More window dressing; dietary supplements do not contain drugs -- they contain food ingredients and there are no foods that are "synthetic anabolic steroids" so this is another meaningless provision.]

Clearly we were right when we called S.3002 a stalking horse for S.510. They wanted to see how we’d react. And we did. Now they’re back to Plan A. Shove Codex in through S.510.

This is something we simply cannot allow to happen. Therefore, we need to drown the Senate in emails. Please go to our Action Item and send the updated message to your Senators.

Time to Push Back again! Time to turn Push Back into Take Down!

Food supplement regulations being considered in Italy may force certain herbal products to carry warning labels, and health indications may become mandatory too, a European Commission committee has heard.

The draft decree relates to substances other than vitamins and minerals and a February meeting of the Standing Committee on the Food Chain and Animal Health (SCFCAH) heard that the Italian government was considering actions with nine nutrients warranting initial focus.

They were Cimicifuga racemosa Nutt; Citrus aurantium L.; Ginkgo Biloba L.; Hypericum Perforatum L.; amino acid mixtures; ramfied amino acids; bioflavonoids; creatine and Monascus purpureus (red yeast rice) monacolin.

While not clarifying exactly why these herbs required warning labels

Ok,hypericum Perforatum=st johns wort,proven to be effective for moderate depression and even some cases of severe depression.Prescribed readilly by doctors in Germany over pharmaceudicals due to it's VERY HIGH SAFETY and EFFECTIVENESS....i think the others i know gingko,been around for a long time,also alot of good studies showing it to be very effective for increasing blood flow to the brain etc citrus aurantium is a stimulant,also i have used this myself no problem...they've actually classed BIOFLAVOINOIDS here...WHAT?...one of the most effective disease fighting chemicals present in plants and fruits available to the human body to resist disease...insane.

Ok,i wrote to the ANH (The Alliance for Natural Health) last week asking for their views on the threat being posed to chinese tonic herbs and alternative health in general.

Dear David

Thank you very much for your e-mail. The key problem with the Traditional Herbal Medicinal Products Directive is that it requires such a high standard of data in order for companies to meet the licensing requirements that, in particular for herbal traditions that are non-European, this will be extremely difficult. Presently, most products from the TCM traditions are sold as food supplements and the UK medicines regulator, MHRA, is very likely to regard any TCM product that contains a herb that has not had a recorded history of food use as medicinal. Accordingly, any such product that then is not able to successfully be registered under the THMPD licensing scheme, will effectively be banned.

To date, not a single TCM product has been successfully licensed and few, if any, such products have been submitted under the registration scheme. The information that we have from companies that produce traditional herbal remedies, is that where there are multiple herbs present, they are having extreme difficulty meeting the technical requirements. This has been our primary reason to work towards bringing a legal challenge against the existing licensing scheme, which is particularly poorly adapted to herbal products from non-European traditions.

As we move towards the challenge, it is going to be very important to ensure that we have a mix of consumer, practitioner, and company representatives who are able to speak to the media about both the challenges posed by the existing licensing scheme and also the benefits offered by products that might be 'caught' by the scheme. If you are interested, we would be very grateful if we could file your details in our consumer group that could be contacted in the event of media interest. Please let us know your thoughts on this.

I've since told them...'COUNT ME IN'....whatever you need......the EU aint gonna tell me what forms of healthcare i can have access to and which ones i cannot...i aint going quietly into the night,i urge anyone else who has had positive experiences with herbal/vitamin supplements to lend your support to the ANH.They are a realy great respectable organisation IMO.
