The kid's finger is in the bowl, so he's not smoking it.
I think we've got a classic case of overreaction here; the baby grabs the bong that daddy forgot on the floor, he's checkin' it out, and everyone is like, "Oh, that's cute!" so they snap a picture. It's the same concept behind Look Who's Talking or... *sigh* all the other talking baby movies.
Lesson to be learned: Put the bong on top of the bookcase next time.
