EU court rules against environmentalists trying to block Spanish wind farms

The Court of Justice of the European Union (CJEU) ruled that Spain’s wind farm permitting process in Galicia aligns with EU law, resolving a dispute raised by environmental group Peton do Lobo. The court clarified that EU environmental impact assessment rules do not mandate a second public consultation after technical reports are submitted, validating Spain’s simultaneous consultation approach.

Spain’s wind energy association (AEE) hailed the decision as a breakthrough, noting it restores confidence for developers and supports the resumption of nearly 100 stalled wind projects in Galicia, totaling 2,500 MW.

Between 2020 and 2024, Galicia added only 171 MW compared to Spain’s 6,000 MW. The AEE urged Galicia’s High Court to expedite pending cases to revive projects, highlighting economic losses in rural areas. Galicia currently operates 186 wind farms, contributing 3,920 MW, or 13% of Spain’s wind capacity.

The Spanish wind industry group AEE called it a "key step toward restoring legal certainty."

However, the activist group Adega expressed disappointment, insisting it undermines public participation rights. There are currently 92 wind farms facing legal challenges in Galicia, worth about 3 billion euros.
