SCOTUS backs parents seeking to opt their kids out of LGBTQ books in elementary schools

SUMMARY

The Supreme Court ruled 6-3 in favor of parents objecting to LGBTQ-themed books approved by the Montgomery County Board of Education for elementary schools. The court emphasized that not allowing an opt-out for their children violated their First Amendment religious rights. Justice Samuel Alito noted the board's actions "place an unconstitutional burden" on parental rights.

The dispute arose in 2022 when the school board revised its curriculum to include LGBTQ-inclusive storybooks. Although initially allowing opt-outs, they later reversed the decision, claiming implementation challenges. Plaintiffs included Muslim parents and members from various faiths who argued that the content conflicted with their beliefs. The Trump administration supported the parents, but earlier rulings favored the school board.
