Trump DOJ quietly abandons Biden autopen investigation
The Trump Justice Department has quietly shelved its investigation into former President Biden’s use of an autopen for signing official documents.
The probe, opened by interim U.S. Attorney Ed Martin — the former “weaponization” czar — never advanced to a grand jury. It was wound down under current U.S. Attorney Jeanine Pirro, a longtime Trump ally.
Prosecutors concluded there is no readily identifiable or applicable criminal statute covering the practice.
The White House referred inquiries to the Justice Department, which declined to confirm or deny the existence of the investigation per policy.
Trump launched the effort in June via executive order, demanding a wide-ranging probe into Biden and his aides. He repeatedly claimed autopen signatures were used to conceal Biden’s cognitive decline.
The Republican-led House Oversight Committee issued a report in October declaring some autopen-signed executive actions “illegitimate” due to Biden’s alleged mental state.
Trump stated in November he would cancel executive orders signed with Biden’s autopen.
Biden responded in June: “Let me be clear: I made the decisions during my presidency. I made the decisions about the pardons, executive orders, legislation, and proclamations. Any suggestion that I didn’t is ridiculous and false.”
No official government record tracks autopen usage frequency.
The abandonment follows other Trump DOJ efforts against political opponents, including failed prosecutions of former FBI Director Comey and New York Attorney General James, both dismissed in November.
