First trans judge appeals to ECHR over Supreme Court ruling

Britain's first transgender judge, Victoria McCloud, is appealing to the European Court of Human Rights (ECHR) after the Supreme Court ruled that "woman" and "sex" in the Equality Act refer to biological sex only. McCloud argues that her right to a fair trial was violated as she was not allowed to present evidence.

Women’s rights groups criticized her appeal, insisting she must pursue all domestic remedies first. McCloud stated, “There is no space for decision-making about us, without us.” Her team has launched a £150,000 fundraiser for the case.

Critics, including Maya Forstater from Sex Matters, dismissed the appeal as “fantasy,” emphasizing the need for all legal channels to be exhausted. McCloud resigned last year, feeling she could no longer practice law without politicizing the judiciary.
